1.1 The Rainmakers platform run by G Gen Labs Sdn Bhd and its affiliates
(individually and collectively, “The “Rainmakers, “we”, “us” or “our”). The
Rainmakers takes its responsibilities under applicable privacy laws and
regulations (“Privacy Laws”) seriously and is committed to respecting the
privacy rights and concerns of all Users of our The Rainmakers website (the
“Platform”) (we refer to the Platform and the services we provide as described
on our Platform collectively as the “Services”). Users refers to a user who
registers for an account with us for use of the Services, including both buyers
and sellers (individually and collectively, “Users”, “you” or “your”). We recognize
the importance of the personal data you have entrusted to us and believe that
it is our responsibility to properly manage, protect and process your personal
data. The purpose of this Privacy Policy ( “Privacy Policy” or “Policy”) is to assist
you in understanding how we collect, use, disclose and/or process the personal
data you have provided to us and/or we possess about you, whether now or in

may have previously or separately provided to us in respect of your Personal
Data, and your consent to this Privacy Policy is in addition to any other rights
which we may have at law to collect, use, process or disclose your Personal

1.4 This Privacy Policy shall be governed by, and construed in accordance with,
the laws of Malaysia under the Personal Data Protection Act 2010. Without
prejudice to your rights under any applicable laws, any dispute arising out of or
in connection with this Privacy Policy and/or the documents referred to herein,
including any question regarding their existence, validity or termination, shall be
referred to and finally resolved by the Courts of Malaysia and both you and we
hereby unconditionally and irrevocably submit to the exclusive jurisdiction of the
Courts of Malaysia.

ethnic origin, nationality;
f. other information required for our due diligence, know your customer,
identity verification, or fraud prevention purposes

and your communication preferences;

2.3 Usage of personal data
We may collect, use, disclose and/or process your personal data for one or
more of the following purposes:
a. provision of the Services as requested by you
b. to verify your identity for the purposes of providing Services to you
c. conducting due diligence checks
d. to detect and protect us or any third parties against negligence, fraud, theft
and other illegal activities

2.4 By using our platform, you agree not to submit any information to us which
is inaccurate or misleading, and you agree to inform us of any inaccuracies or
changes to such information. We reserve the right at our sole discretion to
require further documentation to verify the information provided by you.


3. Disclosure of Personal Data
We will keep your personal data confidential but you hereby consent and
authorise us to disclose and share your personal data to the following
categories of parties :
a. The Rainmakers authorised employees, holding companies, subsidiaries,
affiliates and associates;
b. professional advisers, service providers, third party associates with whom
we have contractual agreements for some of our functions and services
c. strategic/business partners with whom we have a relationship with for
specific products and services
d. financial service providers in relation to the products and services that you
have with us
e. anyone who takes over or may take over all or part of our rights or obligations
under any agreement we have with you or anyone (or any part thereof) which
is transferred to or may be transferred to
f. any party authorised and/or consented by you
g. any authorities or regulators, including foreign regulators for the
performance of their functions, or any party as required by any law or any
government, quasi-government, administrative, court or tribunal


4. Protection of Personal Data
4.1 To protect your personal data from unauthorized access, collection,
duplication, modification use or similar uses, we have implemented proper,
administrative and technical measure as followed:
a. authentication and access controls
b. encryption of data
c. data anonymization
e. regular maintenance of security measures
f. securely erase storage media in devices before disposal
g. web security measures
h. usage of one time password(“OTP”)/ 2 factor authentication (“2FA”)/ multifactor authentication (“MFA”) to secure access
i. security review and testing performed regularly
4.2 Although we uphold the highest level of security to protect your personal
data, you should be aware that no transmission of data over the internet or
electronically storage is completely secured. As such, there is no guarantee that
your personal data will be completely secured, aforesaid, we will strive to protect
the security of your personal data and will constantly review and enhance our
security measures.


5. Storage of Personal Data
We will retain personal data in accordance with the Privacy Laws and/or other
applicable laws. That is, we will destroy or anonymize your personal data when
we have reasonably determined that (i) the purpose for which that personal data
was collected is no longer being served by the retention of such personal data;
(ii) retention is no longer necessary for any legal or business purposes; and (iii)
no other legitimate interests warrant further retention of such personal data. If
you cease using the Platform, or your permission to use the Platform and/or the
Services is terminated or withdrawn, we may continue storing, using and/or
disclosing your personal data in accordance with this Privacy Policy and our
obligations under the Privacy Laws. Subject to applicable law, we may securely
dispose of your personal data without prior notice to you


6. Transfer of Your Personal Data outside Malaysia
Your personal data and/or information may be transferred to, stored or
processed outside of your country for one or more of the Purposes. Some of
our severs are located oversea and as such, whilst transferring your data to
these servers, we will comply with the PDPA and other applicable data
protection and privacy laws in respect of your Personal Data and ensure that
the recipient outside of Malaysia is obliged to protect your Personal Data at the
standard comparable to the protection under the applicable laws


7. Your Rights of Access, Correction or Withdrawal of Personal Data
7.1 In the event that you request for access to your personal data, corrections
to inaccuracies of your data, request to withdraw content of your data, and/or
request for the deletion of your data in our possession or under our control, you
have the right to request the aforementioned by sending an email to our

requests in accordance with this Privacy Policy and our obligations under the
Privacy Laws and other applicable law. By withdrawing consent to your
personal data, we will not be able to continue providing you the Services to you
and we may need to terminate your existing relationship and/or any contracts
you have with us. By using our Services, operating any account maintained with
us, visiting our Platform, websites or mobile applications or otherwise, providing
information to, or communicating with us you shall be deemed to have read and
provided your consent to our collection, use, processing and disclosure of your
Personal Data or Personal Data relating to other persons in the manner as
described in this Privacy Policy.
7.2 You may, at any time, withdraw your consent to receive marketing
information from us. If you wish to do so, please click on the “Unsubscribe”
option available on all marketing/newsletter emails that you may receive from

7.3 You may request for deletion of your personal data and/or communicate
the withdrawal of your consent to the continued use, disclosure and/or
processing of your personal data, by contacting our Data Protection Officer
through admin@therainmakers.com.my. In the event you communicate your
withdrawal of your consent to our use, disclosure or processing of your personal
data for the purposes and in the manner as stated above, we may not be in a
position to continue to provide the Services to you or perform on any contract
we have with you, and we will not be liable in the event that we do not continue
to provide the Services to, or perform our contract with you. Our legal rights and
remedies are expressly reserved in such an event. After you have chosen to
withdraw your consent, we may be able to continue to process your personal
data to the extent required or otherwise permitted by applicable laws and
regulations.


8. Profiling – Know Your Customer (KYC)
We will process some of your data your have provided us as part of our KYC
process for your to obtain access to some of our Services, with the goal of
assessing certain personal aspects (profiling). For example, we may use the
profiling due to certain legal and regulatory requirements, to verify the
declaration of your identity, to combat money laundering, terrorist financing,
fraud, assessment of risk and offences that pose a danger to assets.

respective third party. Therefore, the third party cookies are not subject to our
control and we shall not be liable for any negative impact of the third party

Note : Pursuant to Personal Data Protection Act 2010, this Privacy Policy shall
be in both national (Malay) and English languages.
In the event of any inconsistency or conflict between the English language
version and the Bahasa Malaysia language version of this Privacy Policy, the
English language version shall prevail over the Bahasa Malaysia language
version to the extent of such inconsistency or conflict.
